A Trademark is the exclusive right to use your company name (or logo or tagline). If you don’t have a Trademark, you are basically renting the name until someone comes in and buys it. If you continue to use the name or logo once it has been trademarked by someone else, you’re at risk of being a party in a federal lawsuit. Another perk of trademarking your name? You can make money on your name by licensing it out for a fee.
Trademark Search
Before we file a Trademark application, we conduct a thorough Trademark search for brands using an exact or similar name, logo, or tagline. We’ll analyze whether or not the name is available and the likelihood of receiving Trademark approval.
Trademark Application
We create and file your Trademark application, and since most Trademark applications are denied first, we’ll deal with any Office Action responses and legal arguments that need to be made on your behalf. Once your application is published, we’ll monitor your application and negotiate with other brands as needed.
Trademark Monitoring
We monitor your Trademark on a monthly basis to make sure no one else is using your brand name, logo, or tagline. If necessary we will send a cease and desist letter.
